Cease and Desist Order Issued Over Wale’s “The Break-up Song”

Cease and Desist orders have been issued through legal representation of Monumental Musik Productions, the sole proprietorship owned by music producer Angelo “Lolo” Shepherd, to the networks citing that Wale “unlawfully used the instrumental without the authorization or silence in connection with (i) the advertisement and promotion of music artist Wale, and (ii) the making available distribution and performances of musical work.”

Wale’s “The Break-up Song”, a 2-minute and 12 second song featuring a familiar sample from legendary singer/musician Stevie Wonder’s “All I Do” record, was first released to the public via his twitter account in April 2010 and since then has statistically become his most discussed and listened-to songs of his career. The video for the song which features narration from actor and Academy Award winner Morgan Freeman, premiered as MTV Jam of the Week on Super bowl night in February 2011. The video would also go on to premier on BET’s 106 & Park show in March of this year.

Now after nearly a year of the video is being broadcasted throughout the web and on BET and MTV networks, “It’s imperative that this video (music) is immediately removed from rotation”, said Monumental Musik CEO, Angelo Shepherd, “the consistent play without appropriate financial compensation of the licensed producer’s work represents the theft our industry is currently fighting on Capitol Hill. Fair practices should be expected from consumers and networks alike.”

Gucci Mane to Spend Six Months Behind Bars

Rapper Gucci Mane will spend the next six months in Georgia prison after pleading guilty to two counts of battery, two counts of reckless conduct, and one count of disorderly conduct on Tuesday, September 14th. Mane was reported to have picked up a woman named Diana Graham at suburban Atlanta mall in January, invited her for breakfast and tried to offer her $150 to stop by a hotel with him. When the woman refused, Mane pushed her out of his Hummer while in motion where she suffered from soreness and pain.

The Judge ordered Mane to complete 12 weeks of anger management classes and to pay the victim $5,090 for her medical bills plus $3,000 for damages.

Previous legal issues involving Mane include the November 2010 incident where he was arrested for driving on the wrong side of the road, running a red light or stop sign, damage to government property, obstruction, no license, no proof of insurance and other traffic charges. Later on a judge in the Superior Court of Georgia’s Fulton County ordered the rapper to a psychiatric hospital.

The Flash Mob And Machine Gun Kelly

Experimenting with social media can be like playing with matches. For Cleveland-born rapper, Machine Gun Kelly, activity on his Twitter account has led to his arrest for organizing a flash mob. The event took place in Strongsville, Ohio at the suburban Southpark Center Mall, which is located some 20 miles from Cleveland.

It is illegal in Cleveland to promote flash mobs using social media. For the hundreds of fans who attended the event on Saturday, August 20th, as did Machine Gun Kelly, this fact was of no significance. The rapper was arrested for the charge of disorderly conduct after he refused to get down from a food court table.

The 21-year-old rapper, whose real name is Richard C. Baker, said of his arrest posted defiantly on Facebook:

“If havin’ fun with my fans and bringing the rage back to my hometown means I have to be arrested…then keep pullin’ the cuffs out.”

This self-destructive move has not hurt his career one little bit. In fact, it has enhanced it, as Kelly has just signed a deal with Bad Boy Entertainment, Sean “Diddy” Combs’ company.

Bad boy he is, but fans love the energetic rapper whose namesake was the moniker of a fearsome gangster from the Prohibition Era.

Go figure.

Jon Connor Speaks On Lawsuit Filed By MC Breed’s Wife

Jon Connor’s tribute to the late rapper MC Breed, “Ain’t No Future”, has put the talented rapper in trouble. He is now facing a lawsuit filed by Breed’s widow, Natasha Breed, who is seriously committed to bringing him to court. Ms. Breed’s case is that by sampling her late husband’s “Ain’t No Future In Yo Frontin,” in the creation of “Ain’t No Future,” Connor had committed copyright infringement against the works of MC Breed.

For his part, Connor was coldly indifferent to Natasha’s legal action and labeled the situation as a simple thing that has been blown out of proportion. In an interview with Boss Lady and DJ Green Lantern on Invasion Radio, Jon voiced out his frustrations with Natasha’s decision. He emphasized his sincerity in paying tribute to his hip hop idol MC Breed. “It’s so much negativity that surrounds my city… it’s a tribute”, he stated.

In the interview, Jon said that such a tribute should be viewed as a positive thing and brushed off the allegations made by Breed’s widow. He stated that MC Breed, who, like Connor, hails from Flint, Michigan helped popularize rap music in the 90s for kids like him.

Natasha reportedly filed the lawsuit after learning that “Ain’t No Future” was being sold through iTunes. Natasha said: “Jon Connor who? I seen the whole campaign, I know who’s sponsoring the whole project, I know who’s behind him”. Natasha took offense at the track, claiming that Connor required consent before sampling her husband’s material and was making undue profit from its use.

 

Late Rapper Pimp C’s Widow Speaks Out About Being Sued Over His Recordings

The widow of late rapper Pimp C, Chinara Butler, is being sued by Rap-A-Lot Records about some of his unreleased recordings. According the lawsuit, Rap-A-Lot Records representatives have stated that Butler is withholding 10 master recordings of Pimp C’s music from the label. The lawsuit also stated that the label owns these master recordings due to their contract agreement with Pimp C.

Butler has stated that she is displeased with the music selection for Pimp C’s upcoming album “Still Pimpin.” She feels like the label is trying to do something new with her late husband’s music that he did not do. She also stated that she has not received any compensation for her work on the album as the executive producer.

Before the lawsuit was filed, Butler delivered a letter to the label ordering them to stop using her husband’s name and music for this upcoming album. Butler has also stated that there has been no communication between her and Rap-A-Lot Records CEO James Price since the passing of Pimp C about three years ago.

Pimp C was found dead in his Hollywood, California hotel room in December of 2007. His cause of death was ruled an accidental death due to a drug overdose of Promethazine/Codeine syrup and sleep apnea.

Before his death, Pimp C was a member of the rap group Underground Kingz (UGK) that was based out of Texas. The group released nine albums and earned several music awards. They also were featured on several top hip-hop singles such as “Big Pimpin” by rapper Jay-Z.

The last UGK album “UGK 4 Life” was released in March of 2009 as a tribute to Pimp C’s death. The album debuted sixth on the Billboard 200 music chart.

Producer Jermaine Dupri Sued for Back Child Support

It appears that producer/rapper Jermaine Dupri is facing more financial problems. This week he was hit with a lawsuit in Atlanta, Georgia for failing to pay his child support after he was ordered to by Judge Margaret Dorsey, who is a court judge in Fulton County.

According to her ruling, Dupri was supposed to pay $2,500 per month plus an additional $7,500 to the mother of his seven month old daughter. The mother, Sarai Jones, has not received any payments. The ruling was issued after a court-ordered paternity test revealed that he was the father of the child.

In addition to this lawsuit, Dupri has been facing other financial issues. He currently owes the State of Georgia over $493,000 in back taxes based on his income for 2007. His mansion in Atlanta was set to be auctioned off this month for failure to pay his mortgage and property taxes. The mansion is estimated to be worth $2.5 million. However, the auction was called off before it could take place.

In 1993, he formed his own record label, So So Def Recordings, which was home to several major hip hop and R&B artists in the industry today. Under his label, Dupri has created and produced several hit songs and albums for well-known artists and music groups such as Usher, Bow Wow, Jagged Edge, Da Brat, Xscape, and Mariah Carey.

Aside from producing, he has also had a successful rap career. He has released two albums and is currently planning to release a new album this year. He also has been featured on several hit songs for other artists showcasing his rapping skills.

At this time, there has not been a comment from Dupri or his lawyer on this matter.

Lil Wayne Faces Lawsuit

After being charged with gun possession, rapper Lil Wayne faces another lawsuit over the use of a beat for his 2008 hit “Mrs. Officer”. The song, assisted and produced by Bobby-V, is claimed to contain the beat that was created and used by another rapper Michael “Mali Boy” Bradford. In 2009, the lawsuit was filed charging Lil Wayne to have used the beat in 2008 which was also reworked by producer Deezle for a song called “Popeye” for Lil Wayne’s breakthrough album “Tha Carter III”.

Now things got worse for the Young Money rapper as he could be looking at a very sizable penalty for using the song. Bradford has hired expert musicologist Dr. Felicia M. Miyakawa of Middle Tennessee State University to testify on the validity of his lawsuit. Bradford’s team is insisting that the beat was so blatantly copied that even the average listener can tell the similarity between Mrs. Officer and the original. Part of the issue isn’t so much the masking of the beats but the growing exposure of hip-hop music to audiences. People are catching on more simply because they are hearing more.

Sampling of beats is nothing new in hip-hop – from the first beats of Sugar Hill Gang and Run D.M.C., there were people who have taken beats, but in most cases those beats have been changed and perfected in order to hide the source material.

“Wyclef Jean, who appears ready to announce his candidacy for Haiti’s presidency, owes the Internal Revenue Service more than $2.1 million, according to federal tax liens filed against the musician, The Smoking Gun has learned.”

“In May, the IRS filed a $724,332 tax lien against Jean. Last July, the agency filed a $599,167 lien against the performer. And a $792,269 lien was lodged against Jean in July 2007. The liens cover taxes due on Jean’s individual 1040 returns for 2006, 2007 and 2008.”

Oh, I’m kidding about the conspiracy theory but I know some people will be turning to such theories to validate their love of Wyclef.  And isn’t that what building a strong brand is all about?  [lol]

Suge Knight sued Kanye West a while back for holding a party in South Beach in 2005 where Suge got shot.

And given Kanye's history of violence, I could understand why Suge would blame him, lol!

Now the suit has been moved to Miami where one assumes there is a more profitable legal environment.
